'आपका फ़ंडामेंटल राइट है चैन की नींद लेना'
रामलीला मैदान में पुलिस कार्रवाई के मामले में सुनवाई के दौरान सुप्रीम कोर्ट ने आम आदमी के लिए भी एक बेहद अहम फैसला सुनाया। सुप्रीम कोर्ट ने कहा कि चैन की नींद लेना नागरिकों का मूल अधिकार है, क्योंकि यह जीवन का मूल आधार है।
कोर्ट ने बाबा रामदेव के अनशन के दौरान रामलीला मैदान में सो रहे लोगों पर रात में कार्रवाई करने पर दिल्ली पुलिस को कड़ी फटकार लगाई। कोर्ट ने कहा कि पुलिस ने ऐसा करके लोगों के फ़ंडामेंटल राइट का उल्लंघन किया है।
कोर्ट ने अपने फैसले में कहा, 'इंसान की अच्छी सेहत के लिए नींद बेहद जरूरी है। यह इंसान के अस्तित्व से जुड़ी है। इसलिए यह जीवन की मूलभूत और बेसिक जरूरत है। इसके बिना जीवन संकट में पड़ सकता है।'
जस्टिस बीएस चौहान और स्वतंत्र कुमार की बेंच ने मंगलवार को रामलीला मैदान में रात में शांति से सो रहे लोगों पर कार्रवाई के लिए दिल्ली पुलिस को फटकार लगाई थी। जस्टिस कुमार ने लीड जजमेंट लिखा, तो जस्टिस चौहान ने चैन की नींद की फ़ंडामेंटल राइट के तौर पर व्याख्या की।
उन्होंने सोने के अधिकार को जीवन के लिए जरूरी और प्रिवेसी और भोजन के अधिकार की तरह फंडामेटल राइट माना। यह संविधान के आर्टिकल 21 में राइट टु लाइफ का हिस्सा है। उन्होंने अपने फैसले में कहा, 'प्रिवेसी और सोने का अधिकार सांस लेने, खाने और पानी पीने के अधिकार की तरह फंडामेंटल राइट है।'

कोर्ट ने बाबा रामदेव के अनशन के दौरान रामलीला मैदान में सो रहे लोगों पर रात में कार्रवाई करने पर दिल्ली पुलिस को कड़ी फटकार लगाई। कोर्ट ने कहा कि पुलिस ने ऐसा करके लोगों के फ़ंडामेंटल राइट का उल्लंघन किया है।
कोर्ट ने अपने फैसले में कहा, 'इंसान की अच्छी सेहत के लिए नींद बेहद जरूरी है। यह इंसान के अस्तित्व से जुड़ी है। इसलिए यह जीवन की मूलभूत और बेसिक जरूरत है। इसके बिना जीवन संकट में पड़ सकता है।'
जस्टिस बीएस चौहान और स्वतंत्र कुमार की बेंच ने मंगलवार को रामलीला मैदान में रात में शांति से सो रहे लोगों पर कार्रवाई के लिए दिल्ली पुलिस को फटकार लगाई थी। जस्टिस कुमार ने लीड जजमेंट लिखा, तो जस्टिस चौहान ने चैन की नींद की फ़ंडामेंटल राइट के तौर पर व्याख्या की।
उन्होंने सोने के अधिकार को जीवन के लिए जरूरी और प्रिवेसी और भोजन के अधिकार की तरह फंडामेटल राइट माना। यह संविधान के आर्टिकल 21 में राइट टु लाइफ का हिस्सा है। उन्होंने अपने फैसले में कहा, 'प्रिवेसी और सोने का अधिकार सांस लेने, खाने और पानी पीने के अधिकार की तरह फंडामेंटल राइट है।'

Calculating the last 12 months average it is almost certain that Central employees are likely to get 7 % Dearness Allowance with effect from 1st July 2011.
The index no. for Jan, Feb, Mar, Apr & May 2011 was 188, 185, 185, 186 & 187 respectively.

No hike in retirement age, Govt. clarifies.
New Delhi, Aug 9 (PTI) The government today said there is no proposal to raise the retirement age of its employees from 60 years at present.
"At present there is no proposal to increase the age of retirement of Government servants,"Minister of State for Finance Namo Narain Meena said in a written reply to the Rajya Sabha.
He said this in reply to a query on whether the government was considering increasing the retirement age of all central government employees by two years to 62 years, from the current 60.
The government raised the retirement age of central government employees in 1998, when the age of superannuation was extended from 58 to 60 years.
Meena said the total number of Central Government employees as on March 1, 2010, was 32.24 lakh
The total expenditure incurred by the government after the implementation of the recommendation of the 6th Pay Commission amounts to Rs 94,270.50 crore in the fiscal 2010-11. This was higher than Rs 78,111.20 crore incurred in 2009-10, Meena added.

Government Employees can appeal against adverse ACRs : High Court
Delhi High Court has ruled that a Government employees cannot be denied the opportunity to appeal against adverse Annual Confidential Reports (ACRs), on the grounds that such reports would not be ignored while considering them for promotion.
This was against the Central Administrative Tribunal’s (CAT) directive to a departmental promotion committee to ignore the adverse ACRs of five Indian Revenue Service (IRS) officers while considering them for promotion.
The CAT wanted the adverse ACRs to be ignored, as they were not communicated to the officers in question at the relevant time. Some of the ACRs were three years old at the time of holding the committee and could not be taken into account in view of the May 11, 1990, Memorandum of the Department of Personnel and Training (DoPT). The CAT said there was no point in making any representation in view of the retirement of reporting and reviewing officers.
However, after analysing the Supreme Court judgments in the cases of UP Jal Nigam, Dev Dutt and Avijit Ghosh Dastidar, the HC said: “The question of ignoring adverse ACRs instead of giving a chance of making representation does not arise.”
The Bench said, “All ACRs are to be communicated to the incumbent.”
It said in the case of ACRs being below the benchmark, the affected person could make a representation that would be considered by the relevant authorit, which would be superior to the authority, which gave the adverse ACR.
The high court said the May 11, 1990 DoPT Memorandum, was issued before the recent SC rulings. A new memorandum has already been issued on April 13, 2010, which made it mandatory to communicate to the employee an adverse ACR.

New 5 digit Train number System
A new train no scheme is being adopted by the railway board and supposed to be operational by 20-12-2010.
Under this scheme all train nos will be changed to 5 digits regardless of their being local, passanger, holiday special summer special, suburban or regular train. all the trains will be monitored through PRS, NTES and other technical windows.

आज ३१-०८-२०१० को प्रातः ११:०० बजे हमारे तीन वरिष्ठ साथियों का सेवानिवृत्ति कार्यक्रम काफी मिश्रित माहौल में मनाया गया. इसमें साथियों से बिछुड़ने का गम था तो उनके सफल सेवाकाल का गर्व और ख़ुशी भी सभी के द्वारा महसूस की जा रही थी.

New Direct Tax Code: Pay less in taxes from April 2011
The Cabinet has cleared the Direct tax code and will be introduced in Rajya Sabha, and referred it to a select committee, during the monsoon session.
The new provisions under the Direct Tax Code are as follows:
•Tax for income between Rs. 2 lakh - Rs. 5 lakh: 10%
•Tax for income between Rs. 5 lakh - Rs. 10 lakh: 20%
•Tax for income over Rs. 10 lakh: 30%
The limit for exemptions for salaried people is Rs. 2 lakh, while that for senior citizens is Rs. 2.5 lakh.
Corporate tax has been kept at 30%.
The new Code comes into effect from April, 2011.
After the approval of the Cabinet, the decks are cleared for tabling the legislation in the Monsoon Session of Parliament so that the new Act ushering in reduced tax rates and exemptions may come into effect from next fiscal.
When enacted, the Code will replace the archaic Income Tax Act and simplify the whole direct tax regime in the country.
The Code aims at reducing tax rates, but expanding the tax base by minimising exemptions.
The Finance Ministry had earlier come out with a draft on the (Direct Tax Code) DTC bill, some of whose provisions drew strong criticism from industry as well as the public.
To address those issues, the ministry brought out the revised draft, dropping earlier proposals of taxing provident funds on withdrawal and levying Minimum Alternate Tax on corporates based on their assets.
"As of now, it is proposed to provide the EEE (Exempt-Exempt-Exempt) method of taxation for Government Provident Fund (GPF), Public Provident Fund (PPF) and Recognised Provident Funds (RPF) ...", the revised DTC released by the Finance Ministry said.
The revised draft also puts pensions administered by the interim regulator PFRDA, including pension of government employees who were recruited since January 2004, under EEE treatment.
The first DTC draft had proposed to tax all savings schemes including provident funds at the time of withdrawal bringing them under the EET (Exempt-Exempt-Tax) mode.
Under the EEE mode, the tax exemption is enjoyed at all the three stages - investment, accumulation and withdrawal.
The earlier DTC draft had proposed to reduce the corporate tax to 25 per cent from the present 30 per cent. The revised proposal has also made it clear that tax incentives on housing loans will continue. Payment on interest on housing loans up to Rs. 1.5 lakh will continue. The earlier draft was silent on housing loans.
